Class B Misdemeanor DWI with Reported BAC of .092.

In this case, the driver, a CDL holder, was stopped for speeding in a non-commercial vehicle. At the DOR administrative hearing, I offered the dash cam video, extensively cross-examined the arresting officer about the problems with his DWI investigation, and brought out all of the inconsistencies between the officer’s arrest report and his dash cam video. After doing so, the DOR hearing officer set aside the suspension of my client’s driving privileges, finding that probable cause for his arrest was lacking.

Upon reviewing a transcript of the DOR hearing, and the hearing officer’s decision, the prosecutor dismissed the DWI charge. Pursuant to a plea agreement, my client then pleaded guilty to the speeding charges and paid a small fine. The client did not lose his base driving privileges or his commercial driver’s license.
